BREAKING: Judge Deals Devastating Blow To Jack Smith

In June, President Donald Trump was indicted on thirty-seven counts by Democrat Joe Biden’s Department of Justice (DOJ).

But things didn’t turn out how many on the left wanted as Trump experienced a fortunate turn of events as his preferred judge got the criminal case in Florida.

Judge Aileen Cannon of the Southern District of Florida U.S. District Court, who was appointed by Trump, was given the politically driven case.

In a previous case, Cannon issued several pro-Trump judgments that had those on the left howling mad.

And today the left are even angrier at what she did, dealing a major blow to “special” prosecutor Jack Smith.

In her decision today, Judge Cannon invalidated two of Special Counsel Jack Smith’s confidential submissions. “Judge CANNON comes out swinging at special counsel this morning, striking two of prosecutors’ sealed filings and demanding an explanation of “the legal propriety of using an out-of-district grand jury proceeding to continue to investigate” the docs case,” wrote Kyle Cheney, a legal reporter for POLITICO, in an article.

Journalist Julie Kelly also stated on X (formerly Twitter), “I told you Judge Cannon is legit. She is not going to tolerate Jack Smith’s bullsh*t. This is gold–she asks defense to raise possible grand jury abuse by DOJ for conducting nearly all of the investigation in DC then switching to FLA at last minute for indictment.”

“Cannon also won’t tolerate DOJs nonstop requests for secrecy. She already denied a govt motion asking to keep names of 80+ witnesses under seal.” Kelly continued.

“The Special Counsel states in conclusory terms that the supplement should be sealed from public view ‘to comport with grand jury secrecy,’ but the motion for leave and the supplement plainly fail to satisfy the burden of establishing a sufficient legal or factual basis to warrant sealing the motion and supplement.” Judge Cannon’s verdict declared. She subsequently turned down the prosecution’s motion.

“Among other topics as raised in the Motion, the response shall address the legal propriety of using an out-of-district grand jury proceeding to continue to investigate and/or to seek post-indictment hearings on matters pertinent to the instant indicted matter in this district.” the judge continued in her verdict. She gave the prosecution till August 22nd to answer those and additional items.

The reactions to this news on X were overwhelmingly supportive of Trump, but leftists are clearly upset and want Cannon off the case.

A person named Sloan Ashton who says they are a student posted “Judge Cannon just disclosed the existence of a confidential grand jury proceeding that the DOJ has filed under seal. She must RECUSE herself or be REPLACED. The 11th Circuit cannot let this incompetent person continue to rule on this case. She belongs on a park bench.”

Andrew Weismann whose profile reads “Co-host of MSNBC podcast “Prosecuting Donald Trump” Author, NYT bestseller “Where Law Ends” 20 years at DOJ,” wrote, “Judge Cannon clearly shows her ignorance (bias? both?); the obstruction crimes that were investigated are charges that could have been brought in FLA or in DC and thus could be investigated in either district. And there was conduct that is alleged to have occurred outside FLA.

Jon Cooper whose profile reads “Ex: National Finance Chair of Draft Biden; LI Campaign Chair for Barack Obama; Majority Leader of Suffolk County Legislature. Gay dad of five kids,” posted “Judge Aileen Cannon is either a shameless political hack or a painfully incompetent ignoramus. Either way, she should be forced to recuse herself from Trump’s criminal case.”

In June when it was found out that Cannon would be ruling on Trump’s case, MSNBC commentator Joyce Alene sought to soothe the agitated left by stating that Garland would try to remove Cannon.

According to Alene:

“I used to be an appellate chief in the 11th Circuit (where Florida is) and I litigated a few appeals where we asked the court of appeals to order a judge to recuse.

“Altho a judge’s behavior in court generally doesn’t form the basis for recusal, the 11th Circuit has ordered ‘reassignment’ where a judge leans so heavily for a defendant they call their objectivity in the eyes of the public into question.

“This is persuasive authority that Judge Cannon must step aside if the case falls to her as a permanent assignment.

“Her court & certainly the 11th won’t tolerate the damage it would do to their credibility if she failed to voluntarily recuse.”

ABC News reported at the time:

The summons sent to former President Donald Trump and his legal team late Thursday indicates that U.S. District Judge Aileen Cannon will be assigned to oversee his case, at least initially, according to sources briefed on the matter.

Cannon’s apparent assignment would add yet another unprecedented wrinkle to a case involving the first federal charges against a former president: Trump appointed Cannon to the federal bench in 2020, meaning that, if Trump is ultimately convicted, she would be responsible for determining the sentence – which may include prison time – for the man who elevated her to the role.
